Terms of Service

These terms govern the virtual private server (VPS) service provided by ⚡️Herkül · Fast VPS/VDS ("Provider"). By placing an order you agree to these terms.

1. Service

The Provider automatically deploys a virtual server with the CPU, memory, disk and traffic resources of the selected plan at the time of order and delivers root access to the customer. The customer is responsible for the software, data and security inside the server.

2. Payment and renewal

The service fee is paid in advance for the selected period. If auto-renew is on, the fee is deducted from the balance at the end of the period. If the balance is insufficient, the server is suspended; without payment, the server and all of its data are permanently deleted after the stated period.

3. Backups

Unless stated otherwise, the service does not include backups. You are responsible for backing up your data regularly.

4. Refunds

The fee for orders that cannot be deployed is refunded to the balance automatically. No refunds are given for the remaining term of services that have been deployed and put into use.

5. Acceptable use

The service may not be used in violation of the Acceptable Use Policy. In case of a violation, the server may be suspended or deleted without prior notice, and fees paid are not refunded.

6. Service continuity

The Provider strives for high availability; it cannot be held liable for outages caused by the infrastructure provider, maintenance work or force majeure.

7. Changes

The Provider may update these terms; the current text is published on this page.
